CHALLENGING ISSUES: PATIENT PRIVACY AND HEALTH CARE PROXIES Case: Jane Rider is the health care proxy for her mother, Anna James. Anna is now hospitalized and is not capable of making her own health care decisions. Jane knows she has authority to make medical decisions for her mother. Therefore, Jane would like access to her mother’s medical records. Anna’s health proxy form provided many details about how Jane should make health care decisions should Anna become incompetent. However, Jane believes that she cannot adequately fulfill her obligation to her mother unless she knows everything her mother, if she were competent would have a right to know about her vn prognosis and her health care. The hospital believes that state and federal law preclude its releasing information about Anna to Anna’s daughter. Why might a hospital be concerned about protecting a patient’s private medical information from a surrogate decision maker such as Jane? This assignment requires that you put yourself in a professional situation where an ethical decision has to be made.
