Is the blanket immunity for credentialing determinationsunder HCQIA (Healthcare Quality Improvement Act of 1986) that denysurgical or admitting privileges fair to doctors who are unfairlydenied privileges?  

  • Is economic credentialing fair? For example, if an orthopedistwants to move into an area already served by two orthopedists andthe population isn’t large enough to generate enough orthopediccases to keep a third orthopedist busy, may the hospital where thetwo incumbent orthopedists practice deny surgical privileges to thenew orthopedists solely for economic reasons?
  • Can a hospital deny privileges bases on languageproficiency
